Terms of Service

Agreement to Terms By creating an account, accessing, or using the CreativCurrent website or application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and CreativCurrent ("we," "us," or "our"), operated by Vic Beazzo Creative LLC, St. Augustine, Florida, USA. 2. Description of Service CreativCurrent is a subscription-based creative services platform that provides clients with access to a dedicated senior Creative Director on an ongoing monthly basis. Services include design, motion, and development work depending on the subscription tier selected. The three available subscription tiers are: Core — Design services, $2,950/month Growth — Design and motion services, $4,950/month Apex — Design, motion, and development services, $5,950/month Service availability is capped at a limited number of active clients at any given time. Acceptance of a subscription does not guarantee immediate onboarding if capacity is full. 3. Account Registration To access the Service, you must create an account. You agree to: Provide accurate, current, and complete information during registration Maintain and promptly update your account information Keep your password secure and confidential Accept responsibility for all activity that occurs under your account Notify us immediately at hello@creativcurrent.com if you suspect unauthorized access You must be at least 18 years old and authorized to enter into a binding contract to create an account. Accounts registered on behalf of a company represent that the individual has authority to bind that company to these Terms. 4. Google Sign-In We offer "Sign in with Google" as an optional authentication method. By using this feature, you authorize us to access your Google account email address and basic profile information solely for the purpose of account creation and authentication. We do not access your Gmail, Google Drive, Google Calendar, Google Contacts, or any other Google services. Your use of Google Sign-In is also subject to Google's Terms of Service at google.com/terms. 5. Subscriptions and Billing 5.1 Billing Cycle Subscriptions are billed monthly or annually in advance. Your billing cycle begins on the date your payment is successfully processed. 5.2 Automatic Renewal Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis. 5.3 Payment Processing All payments are processed securely by Stripe. We do not store your payment card information. By providing a payment method, you represent that you are authorized to use it. 5.4 Price Changes We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price change takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing. 5.5 Taxes Subscription fees do not include applicable taxes. You are responsible for any sales, use, or similar taxes based on your location. 6. Cancellation and Refunds 6.1 Cancellation You may cancel your subscription at any time from your Account Settings page. Cancellation stops future billing but does not immediately terminate your access — you retain access through the end of your current paid period. 6.2 Pausing Depending on availability, you may request a subscription pause from within the app. Paused subscriptions are not billed during the pause period. Active work is placed on hold during a pause. 6.3 Refunds All subscription fees are non-refundable except where required by applicable law. We do not provide prorated refunds for partial billing periods. If you believe a charge was made in error, contact us at hello@creativcurrent.com within 30 days of the charge. 7. Scope of Services 7.1 What's Included Each subscription tier includes a defined scope of creative services as outlined on the pricing page at creativcurrent.com. Work is delivered on an ongoing, request-based basis within the active subscription period. 7.2 What's Not Included Services not listed in your tier's scope, stock photo or asset licensing fees, third-party software subscriptions, printing, or production costs are not included unless explicitly agreed upon in writing. 7.3 Request Workflow Work is managed through the CreativCurrent client portal. You may submit requests, review active projects, upload assets, and provide feedback through the dashboard. We operate on a one active project at a time model per subscription unless otherwise specified. 7.4 Turnaround Times Typical turnaround times are provided as general estimates and are not guaranteed. Delivery timelines depend on request complexity, completeness of your brief, and responsiveness of feedback. 8. Intellectual Property 8.1 Your Content You retain full ownership of all content, brand assets, materials, and intellectual property you provide to us. By uploading content to the Service, you grant us a limited license to use that content solely for the purpose of delivering your requested services. 8.2 Deliverables Upon receipt of full payment for the applicable billing period, all final creative deliverables produced for you become your property. We retain the right to display deliverables in our portfolio and marketing materials unless you request otherwise in writing. 8.3 Our Platform All rights in the CreativCurrent platform, website, application, brand, and underlying technology remain exclusively ours. You may not copy, modify, distribute, or reverse-engineer any part of the Service. 9. Acceptable Use You agree not to use the Service to: Submit requests for content that is illegal, defamatory, obscene, or infringes on third-party rights Attempt to gain unauthorized access to any part of the Service or its infrastructure Upload malware, viruses, or any malicious code Impersonate another person or entity Use the Service in any way that could damage, disable, or overburden our systems Violate any applicable law or regulation We reserve the right to refuse, revise, or remove any request or deliverable that we determine, in our sole discretion, violates these guidelines. 10. Confidentiality We treat all client materials, briefs, business information, and project details as confidential. We will not disclose your confidential information to third parties except as necessary to deliver the Service or as required by law. You agree to treat any non-public information about our processes, pricing, or operations as confidential. 11. Limitation of Liability To the fullest extent permitted by applicable law, CreativCurrent and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Service. Our total cumulative liability for any claims arising under or related to these Terms shall not exceed the total fees paid by you in the three months preceding the claim. 12. Disclaimer of Warranties The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. 13. Indemnification You agree to indemnify and hold harmless CreativCurrent, its owner, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights. 14. Termination We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if we reasonably believe continued access poses a risk to the Service or other users. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect. 15. Governing Law These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in St. Johns County, Florida. 16. Changes to Terms We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will notify you by email or via a prominent notice within the Service at least 14 days before the changes take effect.
